ASSUMPTION OF HEALTH RISK

I, herein the Participant, hereby represent and warrant that I am in good physical health and do not suffer from any medical conditions which would limit my participation in the Retreat offered by Lotus Retreats. I understand that it is my responsibility to consult with a physician prior to and regarding my participation in the Retreat, any of the yoga classes, workshops, and any other activities hosted by Lotus Retreats LLC located at the retreats destination and around the World, heretofore referred to collectively as Programs.

In taking part in the Programs at Lotus Retreats LLC, Participant understands and acknowledges that the Participant is fully responsible for any and all risks, injuries or damage, known and unknown, which might occur as a result of participation of the Participant in the Programs.

Note that it is your responsibility to inform the yoga instructor and Lotus Retreats LLC Organizers of your limitations before Programs begin. Please practice mindfully and enjoy the many benefits of practicing yoga!

I am aware that yoga practices and travels such as those which I am undertaking involve hazardous activities, some in remote areas of the world, with a risk of illness, injury or death which may be caused by forces of nature, or other persons and companies known or unknown, or of willful or criminal conduct of third parties.

I am also aware that medical services or facilities may not be readily available or accessible during some or all of the time during which I am participating on the trip. I accept these risks and obligations and I fully assume the risks of travel and work in this type of environment.

I fully and forever release and discharge Lotus Retreats LLC and all other related, affiliated, associated or otherwise connected corporations, partnerships, individuals and other entities and all of their respective officers, directors, employees, contractors, agents, successors and assigns (collectively, the “Releasees”) from any and all costs (including, without limitation, actual legal costs), claims, demands, actions, causes of action and liabilities whatsoever for any and all losses, damages, death or injuries to persons or loss of property, which may be sustained by me in connection with or in any way relating to this trip, due to any cause or reason whatsoever including, without limitation, the reckless, willful or negligent actions or omissions of the Releasees or any other person or persons.

I am entirely responsible for my own personal safety, health, and mental, physical, emotional, and general well-being during and after the retreat. I release the Lotus Retreats Organizers and their representatives and any of their employees, assistants and affiliates of any liability for any injuries or damages mentally or physically I or any of my family members might incur during or after the retreat. I

understand the retreat is in no way psychotherapeutic or medical in nature. The retreat is not involved with the treatment of disease of any kind and does in no way substitute for medical diagnosis or treatment. Lotus Retreats LLC does not treat, prescribe or diagnose any illness, disease or any other physical or mental disorder. Any personal advice or answers to my questions that are given to me on this retreat are for entertainment purposes only. I release Lotus Retreats LLC and their representative and any of their employees, assistants and affiliates from any injuries or damages mentally or physically that I or any of my family members might incur during or after this retreat as a result of following any advice given to me on this retreat. I release Lotus Retreats LLC from any obligation to fulfill any claims about this retreat that have been printed or spoken in any tapes, lectures, letters, literature and the Internet, websites or the news media. I am entirely responsible for my personal safety, health, and well-being during the retreat. I hold Lotus Retreats LLC harmless for anything that might happen to me or to my possessions on this retreat.

I understand that no health insurance nor travel insurance nor medical evacuation insurance is provided by the Lotus Retreats organizers and if I wish to be insured, I have to do this myself. By signing this Retreat Waiver, the participant releases Lotus Retreats Organizers and its representatives from all responsibility and liability.

CODE OF CONDUCT

I, herein the Participant, understand and agree that I will not:
a. Harass,harm,threaten,discriminate,libel,defame,orotherwiseshame and/or injure Lotus Retreats LLC, its owners, officers, employees, instructors, contractors, assigns, affiliates, agents, successors, and all other Participants within the Lotus Retreats LLC Retreat.
b. Infringecopyrights,trademarks,servicemarks,oranyotherintellectual property rights associated with Lotus Retreats LLC.
c. FalselymisrepresentParticipantassociationwithandinvolvementinthe Lotus Retreats LLC Retreat.

d. FalselymisrepresenttheLotusRetreatsLLCRetreatinanyformsuchas, but not limited to, all written or spoken word by Participant, photos, videos, and images taken by Participant, distributed toward another Participant or persons not participating in the Lotus Retreats LLC Retreat.

e. Reproduce,alter,distribute,display,publish,re-sell,shareviaphoto, video or otherwise, all exclusive content distributed to Participant in the Lotus Retreats LLC Retreat.
f. Violate any Program guidelines, rules, and agreements within the Lotus Retreats LLC Retreat.

Participant understands and agrees that Lotus Retreats LLC and its affiliates have the right to immediately expel, without refund or transfer of any kind, a Participant who breaks, or is suspicious of breaking, any section or amount of this Code of Conduct.

FORCE MAJEURE

The term force majeure shall mean any of the following events:
(i) lightning, storms, earthquakes, avalanches, landslides, floods,

washouts and other acts of odd or natural calamities

(ii) (ii) fires, explosions and destruction, whether accidentally or intentionally caused and whether partial or complete, in or of the premises and facilities of either party, if the same materially affects the ability of such party to perform its obligations hereunder

(iii) (iii) civil disturbances, political disturbances, acts of sabotage or terrorism, war, blockades, insurrections, vandalism, riots or epidemics.

For greater certainty, the inability of Lotus Retreats or the client to perform any of its obligations under due to insolvency or financial difficulty shall not constitute an event of force majeure. If an event of force majeure that prevents, delays or

substantially hinders Lotus Retreats or the Client from carrying out some or all of its obligations hereunder shall occur, those affected by such event of force majeure may give written notice thereof to the other party hereto setting out in reasonable detail the nature of such event of force majeure and its effect upon the obligations of the affected party. If such notice is given and the party affected by such event of force majeure (i) takes all reasonable efforts to mitigate or overcome the effect of such force majeure (including procuring alternative performance by another party, if commercially reasonable to do so) and (ii) continues to perform its obligations hereunder, to the extent that such performance is not directly prevented by such event of force majeure, (A) the affected party shall be deemed not to be in default of its obligations hereunder, to the extent that any failure to perform such obligations which would otherwise constitute such default is reasonably attributable to the effect of such event of force majeure, (B) any time period within which such obligations are to be performed pursuant to the terms of this Contract shall be extended for the period of such inability to perform, and (C) the other party may suspend the performance of any of its obligations under this Contract to the extent that they are dependent upon the affected obligations of the affected party or such suspension is otherwise commercially reasonable in the circumstances.

MEDIA RELEASE

I, the undersigned, do hereby consent and agree that the retreat party, its employees, officers, or agents have the right to take photographs, videotape, or digital recordings of me from any trip/event/activity/program and to use these in any and all media, now or hereafter known, and exclusively for the use of our retreat.

I further consent that my name and identity may be revealed therein or by descriptive text or commentary. I do hereby release the retreat, its agents, and employees all rights to exhibit this work in print and electronic form publicly or

privately and to market and sell copies. I waive any rights, claims, or interest I may have to control the use of my identity or likeness in whatever media used. I understand that there will be no financial or other remuneration for recording me, either for initial or subsequent transmission or playback.

Participant understands that all of the Materials, films, videotapes, reproductions, media, plates, negatives, photocopies, and electronic and digital copies of the Materials, are the property of Lotus Retreats LLC. Participant agrees not to contest the rights or authority granted to Lotus Retreats LLC hereunder. Participant hereby interminably indemnifies and holds harmless Lotus Retreats LLC, its employees, contractors, officers, instructors, licensees, agents, successors, and assigns from any claims, actions, damages, liabilities, costs, or demands whatsoever arising by reason of defamation, invasion of privacy, right of publicity, copyright infringement, or any other personal or property rights from or related to any use of the Materials.

This consent is given in perpetuity and does not require prior or future approval by the Participant.

FINAL PAYMENT:

Payment of the balance of the final price is due 90 days prior to the retreat start date.
If full payment is not received by the due date, rates and availability cannot be guaranteed.

If booking is made 90 days or less prior to departure, full payment is due.

The submission of application and payment to Lotus Retreats LLC is binding. Participant is personally responsible for all mandatory payments.

CANCELLATION POLICY:

• -  At time of booking a non-refundable deposit is due.

• -  If participant cancels their reservation 90 days or more before start date - 50% of program funds (not including deposit) are refundable or transferable to another retreat date/location.

- If participant cancels their reservation 90 days or less before the start date - 0% of program funds are available.

COVID-19 POLICY:

- Travel insurance and health insurance are required to travel and attend an international retreat.
- If guests are unable to attend because of Covid-19 related sickness, a positive test or failure to show correct documentation for travel, this trip is nonrefundable. It’s the guest responsibility to fully prepare documentation and health prior to retreat start.

- If Lotus Retreats is unable to host a retreat due to travel restrictions and has to cancel or postpone; all payments (minus the nonrefundable deposit) are refundable or transferable (along with the deposit)
